The $40 Billion Cannabis Industry: Who Benefits?
Herer's vision of legalization was implicitly community-centered: small farmers, local dispensaries, community-controlled production. He imagined that the cannabis economy would benefit the communities most harmed by prohibition, particularly Black and Latino communities disproportionately targeted by enforcement.

The legal cannabis industry is approximately $40 billion annually in the US (2024). Market concentration: the five largest multistate operators (MSOs) control approximately 20% of licensed revenue. Venture capital investment: $4.2 billion in 2021 (down from peak). The racial equity gap: Black Americans own approximately 4% of cannabis businesses. Social equity license holders have faced systemic barriers, access to capital, banking restrictions under federal law, regulatory compliance costs, that favor well-capitalized applicants over community members most harmed by prohibition. Cannabis remains the fastest-growing industry in America; its growth has not transferred economic value to the communities Herer was writing about.
